Privacy Policy and Personal Information Collection Statement (the “Statement”)

Our Pledge

This Statement is applicable to Metro Broadcast Corporation Limited and Multi-Metro Limited. Accordingly, references to “we”, “our”, “us”, or “our company” shall mean, as the case may be, both companies.

Please note that this Statement may be amended from time to time without prior notice.  You are advised to check the latest version on a regular basis.  If there is any inconsistency or conflict between the English and Chinese versions of this Statement, the English version shall prevail.

Privacy Policy

1.1 Our Pledge

We are committed to safeguarding the privacy of individuals with respect to personal data. We assure that our policies and practices, and those adopted by our affiliated companies and agents in relation to the collection, use, process, retention, disclosure, transfer, security and access of personal data comply with the requirements under the Personal Data (Privacy) Ordinance (Chapter 486) (the “Ordinance”) under the laws of Hong Kong, as well as the relevant code of practice and guidance issued by the Office of Privacy Commissioner for Personal Data, Hong Kong.  The meaning of the term “personal data” adopted in this Statement is defined in the Ordinance.

Where our operations are subject to privacy legislation other than that of Hong Kong (such as due to our carrying out of operational functions outside of Hong Kong), this Statement shall apply so far as it is consistent with such local legislation.

1.2 Collection of Personal Data and Information

At times, you may be required to give your personal data and information to us in several ways from different parts of our websites and our mobile app during registration of members or other online activities, including, but not limited to, your name, gender, age, contact phone number, email address, date of birth, address, education level, occupation, household income and interests etc. Refusal to provide such information may render us unable to handle any application or request you are making, or may deny you access to certain parts of our websites and/or our mobile app, or may otherwise defeat the objectives of your visit. If you are under the age of 18, consent from your parent or guardian is required before you give us any personal data.

In accordance to this Statement, our company’s primary goal in collecting personal information is to provide you, the user, with a customized experience on our network of sites, mobile app and other activities.  This includes personalization services, interactive communications, online shopping and many other types of services, most of which are completely free to you.

1.3 Cookies

When you visit our websites, we will record your visit (including (but not limited to) browsing behavior when browsing this website, the routes to access, search history, geographic location, details of browser, Internet Protocol address (IP), etc, but will not collect any personal data from you unless otherwise stated. Some of our websites may disclose such non-personally identifiable aggregate statistics relating to our visitors to advertisers, This type of data may include, but is not limited to, the browser type and version, operating system, IP address and/or domain name.

Cookies used (if any) in any part of our websites will not be deployed for collecting personal data. For your information, Cookies are small computer files that can be stored in web surfers' computers for the purposes of obtaining configuration information and analyzing web surfers' viewing habits. They can save you from registering again when re-visiting a website and are commonly used to track your preferences in relation to the subject matter of the website. You may refuse to accept Cookies by modifying the relevant internet options or browsing preferences of your computer system, but to do so you may not be able to utilize or activate certain available functions on our websites.

Our websites lets advertisers, sponsors or other companies that show advertisements on some of our pages set and cannot restricted access to their Cookies on your computer. Advertisers, sponsors or other companies do not have access to our websites’ Cookies and the use of their Cookies are subject to their own privacy policies, not this one.

1.4 Use of Personal Data Collected

Specific purposes for which your personal data may be used are set out in our Personal Information Collection Statement as set out in Part 2 below.

1.5 Access to, Correction and Deletion of Information

Under the Ordinance, you have the right to:
(i) check whether we hold any of your personal data;
(ii) access your personal data held by us;
(iii) request us to correct any inaccurate personal data held by us;
(iv) require us to delete all your personal data held by us; and
(v) ascertain our policies and practices established (from time to time) in relation to collection and use of personal data.

We will respond within 40 days after receiving the request. We may charge you a reasonable fee for each personal data access. However, such fee will be waived if the data access is made for the purpose of correcting your personal data.

1.6 Security of personal data

Keeping your personal data private is vitally important to us, and our staff are required to strictly adhere to our internal policy and procedure of data privacy.  Physical records containing personal data are securely stored in locked areas when not in use.  Access to such physical and/or computer records is strictly controlled and requires management approval for each access.  Approvals for access to your personal data are granted only on a “need to know” basis.  We use various encryption techniques to transmit your personal data via the Internet, which can only be accessed by our authorized personnel.   Given the operational nature of the Internet, we cannot guarantee that the transmission is fully secure.  Please refer to our “Security Statement” in Part 3 below for details on the steps that we have taken to ensure that any personal data collected by us via our websites and mobile app is safe and secure to avoid unauthorized interference by third parties. 

1.7  Retention of the Information

If you are a member of ours, your personal data which you have given us via our websites or our mobile app, during the service subscription period will be erased in accordance with our internal policy and procedure upon termination of your subscription.

2.  Personal Information Collection Statement

2.1    As a member, visitor or user of our websites, it may be necessary for you to provide us with your personal data and information when you register with us and/or continue to subscribe with us for a service and/or product, or entering a lucky draw, an interactive game and using our message board services, or participate in any business collaboration program launched by us.  If your personal data is incomplete or incorrect, we may not be able to provide or continue to provide the services to you or to allow you to participate in any of the event aforesaid.   We shall keep your personal data confidential at all times.  Our policies and practices with respect to the collection, use, retention, disclosure, transfer, security and access of personal data will be in accordance with requirements under the Ordinance and this Statement.  We may use and retain the personal data provided by you for the following purposes and for other purposes as shall be agreed between you and us or required by law from time to time:  

(i) Processing of your application for service or participation in any of the event aforesaid, and provisioning of the services by us, our affiliated companies or our business partners (as the case may be);
(ii) Subject to your consent, we may use your personal data and information in connection with the provision of member services (including name, gender, telephone number, email address, date of birth, address) and direct marketing and promotional campaigns undertaken either by us or in conjunction with client companies, like carrying out of market research and marketing of goods and/or services (including: travel and accommodation, transportation, insurance, banking, finance, education, media, recruitment, entertainment and leisure, health and beauty, medical, fashion and apparel, watch, jewelry, electrical and electronic products, telecommunications, information technology, games products, restaurants and catering, real estate agency, concierge services, social network services, public section, environmental and charity) (irrespective of whether we are remunerated for such marketing activities) relating to us, our affiliated companies, business partners and CK Group (including CK Hutchison Holdings Limited, CK Asset Holdings Limited, any of their subsidiaries and any company in which the same has a direct or indirect interest or with which it is in joint venture or co-operation or their respective successors and assigns) via direct marketing telephone calls, e-message [1], e-mail, facsimile, direct mailings etc (“the Advertising Materials”).
(iii) Processing of any benefits arising out of the services and carrying out market research to enhance service quality or experience;;
(iv) Analyzing, verifying and/or checking of your credit, payment and/or status in relation to the provision of the Services;
(v) Processing of any payment instructions, direct debit facilities and/or credit facilities requested by you;
(vi) Facilitating the daily operation of your account, provisioning of customer services and/or the collection of amounts outstanding in your account in relation to the services.
(vii) Enabling us to perform any obligations on interconnection or conform with other industry practices, or to comply with any requests stipulated by governmental or regulatory authorities; and
(viii) Enabling us in prevention of crime.

[1] E-message means electronic messages delivered via the following means: mobile short messaging service (SMS) / multimedia messaging services (MMS) / cross-platform mobile messaging application (e.g. smartphone messaging application).


2.2    We will not disclose any of your personal data or information except when we have your permission or under circumstances, such as when we believe in good faith that law/regulations requires it or under the circumstances described below:

(i) Business Partners & Sponsors

Promotions, games, message boards, and some activities that run on our websites and mobile app may be sponsored by other companies other than us or may be co-sponsored by us.  Some or all information collected during the activity may be shared with the sponsor in order for the activity to be performed.  Details of shared use can be found in specific Terms and Conditions under that particular activity section.  If your personal information is to be disclosed to a third party or shared by any company other than us, you will be notified prior to the time of the information collection or transfer.  If you do not want your data to be disclosed or shared, you must immediately choose not to allow the transfer by not participating in the activity.

Occasionally, you may be offered the opportunity to receive materials or special offers from us and our business partners and sponsors.  If you indicate your intention to opt-into receive information from these third parties, we will (with your permission) share all or part of your personal information with them and you will be receiving the Advertising Materials from us, or our business partners and sponsors.
In cases where business partners and sponsors are involved in order to perform the activity to serve you, these business partners will have separate privacy and personal information collection practices.  We have no responsibility or liability for these independent policies, and it is your duty to find out before you make a choice.

(ii)  Third Party Data & Data in the Aggregate

In order to provide services free of charge, we display advertisements.  You shall agree to receive the relevant advertisements and content from the Advertising Materials from us.  We ensure that business partners, sponsors and advertisers never have access to individual account information unless we are given your permission to do so, as stated under “Business Partners & Sponsors” above.   Only selected personal information of yours collected through our websites, mobile app and/or other activities will be used for compiling aggregate statistics about individuals registering with us in order to present our services to current and prospective partners, advertisers, and other third parties, and for other lawful purposes.  You can be assured that the aggregate statistics do not include any personally identifiable information about any individual user.

(iii) Our Merchants & Shopping

If you make a purchase from our store, or an affiliated merchant on our websites and/or mobile app, the information obtained during your visit to those stores, and the information you give such as your credit card number and contact information, is provided to the merchants.  This is to enable transactions to take place.  Merchants listed on our websites and/or mobile app have separate privacy and data collection practices.  We have no responsibility or liability for these independent policies and you must find out yourself.  You are advised to visit the merchant’s home page and click on their information link for more details about the privacy policies of the merchant and their store.

(vi) Our Agents and independent contractors

We may transfer and disclose your browsing information on our website to agents and independent contractors which we authorize to assist in processing and analyzing user behavior and preferences, so as to understand the popularity of each part of our websites and optimize the content and advertisements.

The browsing information is restricted to be accessed by the agents, independent contractors and their employees.  These agents, contractors and their employees must comply with this Statement when accessing these personal data.

(v) Others

We may also disclose such personal information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating our Terms of Service or may causing physical or non-physical injury to or interference with (either intentionally or unintentionally) our right or property, other users of ours, or anyone else that could be harmed by such activities.  We may disclose or access such personal information when we believe in good faith that the law/regulations requires it and for administrative and other purposes that we deem necessary to maintain, service, and improve our products and services.  For the aforementioned, if you do not want your data to be disclosed or shared, you are advised not to use/participating that particular service, marketing activities or games.

If you do not wish your personal data to be used for the purpose of marketing and promotional activities by us, and our business partners and sponsors, or for us to disclose, transfer or use your personal data for the aforesaid purposes, please make such request to our Data Protection Officer (please quote your name, address and account number) in writing.  Details of our address and email address are stated in Part 1.5.   However, please be reminded that inaccurate and inadequate personal information from you may result in us being unable to provide services and deliver up-to-date membership news and information to you.  

3. Security Statement

While internet is not an inherently secure environment for communications, security of internet communications can be enhanced by the application of appropriate technology.  However, internet security is not solely a technical issue, knowledge on security of personal and transaction data as well as general measure are equally important.  “Hackers” could only attack a system through a “door”.  However, in most cases imprudent transmission and handling of sensitive data such as confidential documents, password, and personal identifiers etc. would facilitate unauthorized access to such a “door” by “hackers”.  Hence, internet users should be cautious when handling such kind of sensitive documents and data.

In order to prudently preserve all personal data obtained from users of our websites, apart from firewalls and other sophisticated technical facilities, we also provide and maintain other stringent security measures so as to protect our system as well as the information and data retained therein from accidental or malicious destruction or damage.
